How we collect, use, and disclose information through haymakersre.com and haymakersins.com. We do not sell your personal information.

This Privacy Policy describes how Haymakers, Inc., including its division doing business as Haymakers Insurance Agency (collectively, “Haymakers,” “we,” “us,” or “our”), collects, uses, and discloses information in connection with haymakersre.com, haymakersins.com, and related pages, subdomains, forms, and services (the “Site”).
By checking the acceptance box and submitting any form on the Site, and by continuing to use the Site, you agree to this Privacy Policy and to our Terms of Use. If you do not agree, do not submit any form and do not use the Site.
This Policy is incorporated into and governed by the Terms of Use, including its disclaimers, limitations of liability, and its mandatory mediation and individual binding arbitration provisions venued in Santa Barbara, California.
Information you give us. When you submit a form, call, text, or email us, we collect what you choose to provide, which may include: your name, email address, telephone number, mailing or property address, the property, business, loan, or coverage you are asking about, values, renewal or closing dates, current carrier or lender, your stated timeline and objectives, and anything else in your message or attachments.
Information collected automatically. When you visit the Site we and our service providers may collect: IP address, approximate location derived from it, device and browser type, operating system, screen and language settings, referring and exit pages, pages viewed, links clicked, dates and times of access, session duration, and similar diagnostic and usage data.
Information from other sources. In the ordinary course of our brokerage, financing, and insurance business we may receive information about you from third parties, including multiple listing services, public records, county assessors, title and escrow companies, lenders, insurance carriers and wholesalers, appraisers, inspectors, contractors, referral sources, and commercially available data providers.
We do not intentionally collect government identification numbers, financial account numbers, or health information through the Site's forms, and you should not submit them through the Site. If you do, you do so at your own risk and on the terms of this Policy.
Analytics. We use privacy-oriented, first-party, cookieless web analytics to understand aggregate Site usage. That measurement is essential to operating the Site and runs regardless of your advertising choice below.
Advertising technologies. Subject to your consent, we use third-party advertising and measurement technologies on the Site, which may include the Meta (Facebook/Instagram) Pixel, Google Analytics 4 and Google Ads tags, the LinkedIn Insight Tag, and the TikTok Pixel. When enabled, these technologies set cookies or similar identifiers and transmit information to those platforms — typically your IP address, browser and device data, the pages you view on the Site, actions such as submitting a form, and a platform identifier if you are logged in to that platform. They allow us to measure our advertising, build audiences, and show you our ads on those platforms and elsewhere. We do not send those platforms the contents of your form submissions. We do not deploy session-replay software.
Your consent controls whether they run. On your first visit we present a banner. No third-party advertising technology loads until you click Accept. If you decline, none of them load and the Site works normally. You may change your choice at any time using the cookie and advertising preferences link, also available in our footer.
Cookies and similar technologies. The Site may use cookies, local storage, pixels, tags, and similar technologies that are strictly necessary to operate the Site, remember your preferences, and measure aggregate usage. Most browsers let you refuse or delete cookies; if you do, parts of the Site may not function.
Your consent to measurement (please read). By using the Site, you expressly consent to the collection, recording, interception, storage, transmission, and analysis of your interactions with the Site — including page views, clicks, referring URLs, device and network information, and similar data — by Haymakers and by our analytics and hosting service providers acting on our behalf. You further consent to those service providers acting as our agents for that purpose. This consent is given knowingly and voluntarily as a condition of your use of the Site.
Do Not Track. Some browsers transmit “Do Not Track” or similar signals. There is no consistent industry or legal standard for responding to them. Haymakers does not respond to, and does not honor, Do Not Track signals or other mechanisms that automatically communicate a choice not to be tracked. This disclosure is provided under California Business and Professions Code section 22575(b).
Third-party tracking across sites. If you consent to advertising technologies, the platforms named above may collect information about your online activities over time and across different websites and services, and may combine it with information they already hold about you. Their handling of that information is governed by their own privacy policies, not this one. If you decline, we do not authorize any such collection through the Site. We cannot control, and are not responsible for, the practices of any third-party platform or any third-party site you reach through a link. This disclosure is provided under California Business and Professions Code section 22575(b)(6).
We may use information for any lawful business purpose, including to:
Aggregate and de-identified information. We may create aggregated, anonymized, or de-identified information from any data we hold, and we may use and disclose that information for any purpose, indefinitely and without restriction, provided it does not reasonably identify you.
Submissions are not confidential. Except where a separate signed agreement or applicable law provides otherwise, information you submit through the Site is submitted on a non-confidential basis, as further described in the Terms of Use.
We do not sell your personal information for money. However, if you consent to advertising technologies, our use of them may constitute “sharing” personal information for cross-context behavioral advertising, and in some interpretations a “sale,” as those terms are defined under California law. You can prevent this entirely by declining at the consent banner or by using the cookie and advertising preferences link.

This section applies where Haymakers, doing business as Haymakers Insurance Agency (California insurance license #6015336; Florida #G083894), collects information in connection with an insurance transaction, and is provided in connection with the California Insurance Information and Privacy Protection Act, California Insurance Code section 791 et seq., and the regulations at title 10, California Code of Regulations, sections 2689.1 et seq.
Information may be collected from persons other than the individual proposed for coverage. In evaluating an application, a renewal, or a claim, information may be collected from you, from other persons proposed for coverage, and from third parties including insurance carriers and their representatives, prior and current insurers, insurance support organizations, loss-history and claims databases, inspection and appraisal firms, wildfire and catastrophe risk modelling and brush-scoring services, public records, and property data providers.
Types of information. Information collected may relate to the property or business to be insured and its construction, condition, occupancy, protection, and exposure; prior insurance history, non-renewals, cancellations, losses, and claims; mitigation and hardening work; and general identifying and contact information.
Disclosures without prior authorization. Information may be disclosed without your prior authorization to the extent permitted by Insurance Code section 791.13, including to insurance carriers, wholesalers, and their representatives for underwriting, rating, servicing, or claims purposes; to insurance support organizations; to persons performing business, professional, or insurance functions for us; to regulatory and licensing authorities; and as otherwise permitted or required by law.
Your rights. Subject to and in the manner provided by Insurance Code sections 791.08 through 791.12, you may request access to recorded personal information about you that is reasonably locatable and retrievable, and may request correction, amendment, or deletion of such information. Requests must be made in writing to the address below and must reasonably describe the information sought. Certain information, including information collected in connection with, or in reasonable anticipation of, a claim or a civil or criminal proceeding, is not subject to access.
Marketing opt-out. You may opt out of marketing email by using the unsubscribe link in any marketing message, opt out of text messages by replying STOP, and opt out of marketing calls by telling us. We may continue to contact you about a transaction you have asked us to pursue and for other non-marketing purposes.
Reviewing and updating your information (California Business and Professions Code section 22575(b)(2)). You may request to review or change the personal information you have submitted to us by emailing team@haymakersre.com or writing to the address below with enough detail for us to locate the information. We will respond within a reasonable time. We may decline a request where we cannot verify your identity, where the request is unreasonable, repetitive, or excessive, or where retention is required for our recordkeeping, licensing, supervisory, legal, or dispute-resolution purposes.
Shine the Light (California Civil Code section 1798.83). We do not disclose personal information to third parties for those third parties' own direct marketing purposes.
The California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”), applies only to a business that meets one or more statutory thresholds relating to annual gross revenue, the volume of California consumers' personal information bought, sold, or shared, or the share of revenue derived from selling or sharing personal information. Haymakers does not believe it currently meets those thresholds, and nothing in this Policy is an admission or assumption that the CCPA applies to Haymakers.
To the extent the CCPA does apply to any processing described here, then with respect to that processing you may have rights to know, access, correct, delete, and limit certain uses of sensitive personal information, and to be free from retaliation for exercising those rights. We would honor such rights as and to the extent required by law. To make a request on that basis, contact us at the address below and identify the request as a CCPA request. We may require information sufficient to verify your identity and authority, and may decline requests to the extent permitted by law.
Opt out of sharing. We do not sell personal information for money. Where you have consented to advertising technologies, that use may constitute sharing for cross-context behavioral advertising, and you may opt out at any time via the cookie and advertising preferences link, which withdraws consent and stops those technologies from loading. We have no actual knowledge of selling or sharing the personal information of consumers under 16 years of age.
Certain information we handle is subject to sector-specific privacy regimes, including the Insurance Information and Privacy Protection Act and the Gramm-Leach-Bliley Act and their implementing regulations, and information regulated by those regimes may be exempt from the CCPA.
We retain information for as long as we consider necessary for the purposes described in this Policy, and we may retain it indefinitely. Relevant considerations include our ongoing and prospective business relationship with you, our recordkeeping obligations as a licensed real estate brokerage and insurance agency, the applicable statutes of limitation, and our need to establish, exercise, or defend legal claims. We may retain information after you ask us to stop contacting you in order to honor that request.
We use commercially reasonable administrative and technical measures intended to protect information in our possession.
NO METHOD OF TRANSMISSION OVER THE INTERNET AND NO METHOD OF ELECTRONIC STORAGE IS FULLY SECURE. HAYMAKERS DOES NOT WARRANT OR GUARANTEE THE SECURITY OF ANY INFORMATION, AND YOU TRANSMIT INFORMATION TO US AT YOUR OWN RISK. We are not responsible for the security practices of any third party, including any service provider, transaction participant, or third-party site.
Email and text message are not secure channels. Do not send government identification numbers, financial account numbers, passwords, or other sensitive information to us by email, text, or through the Site.
The Site may link to or incorporate content from third-party websites and services. This Policy does not apply to them. Haymakers does not control, endorse, or assume responsibility for any third party's privacy or security practices, and shall have no liability arising from them. Review the privacy policy of any third party before providing information to it.
The Site is intended for persons 18 years of age and older and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided information to us, contact us at the address below and we will take reasonable steps to delete it.
To the maximum extent permitted by applicable law, Haymakers shall have no liability whatsoever arising out of or relating to this Policy, the collection, use, disclosure, retention, loss, or unauthorized access to any information, or any act or omission of any service provider, transaction participant, or third party. The disclaimers, exclusions, fallback cap, and statutory carve-outs set out in the Terms of Use apply equally to this Policy and are incorporated by reference.
Nothing in this Policy purports to limit or exempt Haymakers from liability for fraud, willful injury, or violation of law where such limitation is prohibited by California Civil Code section 1668 or other applicable law, or to waive any right or remedy that cannot lawfully be waived. If any provision is held unenforceable, it shall be limited or severed to the minimum extent necessary and all remaining provisions shall remain in full force and effect.
Any dispute arising out of or relating to this Policy is governed by the dispute-resolution provisions of our Terms of Use, which require written notice, mandatory non-binding mediation as a condition precedent, and then final and binding arbitration on an individual basis in Santa Barbara, California, waive class and representative proceedings, and require any claim to be brought within one year. California law governs, and Santa Barbara County, California is the exclusive venue.
We may change this Policy at any time, in our sole discretion, without prior notice. Changes take effect when the revised Policy is posted on the Site, and the version posted at the time of your use governs that use. We will update the effective date at the top of this Policy when it changes. Your continued use of the Site after a change constitutes acceptance of it. This disclosure is provided under California Business and Professions Code section 22575(b)(3) and (b)(4).
